Privacy Policy

This Privacy Policy explains how the Note Recall mobile application (the “App”), provided by 43rd Element, LLC (“we,” “us,” or “our”), handles your information. It should be read together with our Terms of Use.

1.The Short Version

Note Recall is designed to be private by default:

  • We have no accounts, and no servers of ours ever see your content. We never receive, store, or have access to your notes, health data, or any other content you create in the App.
  • Your content stays on your device and, if you enable iCloud, in your own private iCloud account — which only you control.
  • The AI that powers the App runs entirely on your device. Your content is never sent to any AI service.
  • The only time the App connects to the internet for its core function is a one-time download of the AI model from a third-party host (Hugging Face). That download does not include any of your content.
  • The App does send a small amount of anonymous usage data — which features get used, and how fast the on-device AI runs — to a privacy-focused analytics service. It contains none of your content and cannot identify you. See Section 5.

The sections below give the detail.

2.Information We Do Not Collect

Aside from the anonymous usage analytics described in Section 5, the App has no developer-operated backend and no user accounts. We do not collect, receive, transmit, or store:

  • your notes, tags, facts, insights, or chat history;
  • your health, symptom, or medication data;
  • your name, email address, contacts, or precise location;
  • your payment or financial information (purchases are processed by Apple — see Section 7); or
  • an account profile of any kind (there is no sign-up or login).

3.Information Stored On Your Device and in Your iCloud

The following information is created and stored locally on your device using Apple’s SwiftData, and — if you have iCloud enabled — synced to your own private iCloud (CloudKit) database:

  • Notes and related content you create (notes, tags, extracted facts, chunks, and insights).
  • Chat history — your conversations with the App, including message text, timestamps, and a record of which of your notes were used as sources.
  • Logs you create or that the App derives, which may include symptom logs, medication logs, event logs, and task logs.
  • App settings and preferences.

This data resides on your device and in your personal iCloud account. We cannot access it. iCloud syncing is handled by Apple under Apple’s Privacy Policy and your iCloud settings; you can disable iCloud sync for the App in iOS Settings.

4.AI Model Download and Network Connections

To enable its on-device AI features, the App downloads an AI model (currently Qwen3 4B, approximately 2.4 GB) from Hugging Face, a third-party model host. When this download occurs:

  • The request is a standard download of model files. None of your content, notes, or health data is included in or sent with this request.
  • Hugging Face may receive standard technical information inherent to any internet request (such as your IP address) and processes it under its own privacy policy.

Aside from this model download, iCloud sync (handled by Apple), and the anonymous usage analytics described in Section 5, the App does not send your information over the internet.

5.Analytics, Advertising, and Tracking

We display no ads, and the App does not track you across apps or websites. There are no advertising SDKs, no use of the advertising identifier (IDFA), and no sharing of your information with data brokers or ad networks.

The App does include one privacy-preserving analytics service, TelemetryDeck, which we use to understand how the App is used in aggregate — for example, how many people try Demo Mode before subscribing, and how long the on-device AI takes to process a note. What gets sent:

  • A small, fixed set of event names that we defined in advance, such as “Demo Mode entered,” “paywall viewed,” “subscription started,” and “fact extraction completed” (with how many seconds it took). One event also reports how much memory the App itself was using when iOS asked it to free some up, so we can tell how close the AI comes to the limits of different devices.
  • An anonymous install identifier — a random ID generated on your device the first time you open the App. It is not your name, email, Apple Account, or the advertising identifier, and TelemetryDeck salts and hashes it before it is transmitted. It exists so that counts are meaningful (so we can tell one install apart from another); it cannot be used to identify you, and deleting the App discards it.
  • Basic technical context attached automatically by the analytics SDK: app version and build, device model and screen size, iOS version, language, region and time zone, light/dark mode, and accessibility settings such as larger text or reduced motion.

None of your content is ever included — no notes, titles, tags, facts, insights, or chat messages, and no health, symptom, or medication data. Nothing you have typed is sent.

As with any internet request, the receiving servers see your IP address; we never receive it. TelemetryDeck processes this analytics data on our behalf under its own privacy policy, and it is not sold or used for advertising.

6.How We Use Information

Because we do not receive your content, we do not use it. The anonymous usage data described in Section 5 is used only in aggregate, to see which features people actually use and to catch performance problems. All processing of your content — searching, chat, tagging, fact extraction, and insight generation — happens locally on your device to provide the App’s features to you.

7.Purchases

The App is a paid, subscription-based application, purchased through the Apple App Store. Apple processes all payments; we do not receive or store your payment card or other financial information. Apple’s handling of your purchase is governed by Apple’s Privacy Policy and the Apple Media Services Terms and Conditions. Apple may provide us with aggregate, non-identifying sales information, but not your payment details.

8.Data Sharing

We do not sell, rent, or share your information, because we do not have it. The only third parties involved are:

  • Apple — provides the device operating system, processes your App Store purchase, and, if you enable it, syncs your data within your own iCloud account.
  • Hugging Face — hosts the AI model you download (see Section 4).

Your relationship with these providers is governed by their respective privacy policies.

9.Data Retention and Deletion

Your content persists on your device and in your iCloud account until you delete it. You can:

  • delete individual notes, chats, or logs within the App;
  • remove all App data by deleting the App from your device; and
  • manage or remove iCloud-synced data through your iCloud settings.

Because we have no access to your data, we cannot delete it for you, and deletion is entirely within your control.

10.Security

Your data is protected by the security of your device and your Apple ID, including device encryption and iCloud’s protections. We encourage you to secure your device with a passcode, Face ID, or Touch ID. Because your data does not reside on our systems, it is not exposed to a breach of any system operated by us. No method of storage is 100% secure, and we cannot guarantee absolute security.

11.Children’s Privacy

The App is not directed to children under 13, and we do not knowingly collect information from children. (As noted above, we do not collect personal information from any user.) If you believe a child has used the App inappropriately, control of the underlying device and iCloud account rests with the account holder.

12.Your Privacy Rights

Depending on where you live, you may have rights under laws such as the EU/UK GDPR or the California Consumer Privacy Act (CCPA/CPRA) — such as the right to access, correct, or delete personal information, or to know how it is used.

Because we do not collect or hold any of your personal information, there is generally nothing for us to access, export, or delete on your behalf — you already hold and control all of your data directly on your device and in your iCloud account. 13.Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above. If we make material changes, we will provide notice within the App or through the App Store listing as appropriate.
